Domain registration scam in China

Various companies in China are trying to scare domain owners in other countries into registering Chinese variants of their domain names by claiming some other party was trying to register these variants. Examples of this scam have been reported widely throughout 2008, involving the domains asiaton.cn, erimut.com, erimart.com, erimart-domains.com.cn, hknsc.hk, hongkongnet.org, hk-net.org.cn, hknetwork.hk.cn and others (erimut.com, erimart.com, erimart-domains.com.cn and hknsc.hk are linked by IP address).

Here is one that I received on 2008-12-08, originating from IP 58.38.209.249:

Dear CEO,

We are Asiaton Network Service Co., Ltd, which is the Internet Trademark&domain name register center in China. I have something need to confirm with you. We have received an formal application. An international company named “ROB GmbH” wants to apply “joewein” for its own Internet Trademark and CN domain name on Dec 8, 2008 in china. We need to know your opinion because the Internet Trademark And CN domain name may relate to the copyright of your company name on internet. If your company do not intervene in it,we will formally consent their registration
because the registration principle is that “Every company or individual can register the domain name and Internet Trademark which is not registered, and who registers first who owns first.”
we would like to get the affirmation of your company. If you have any question, please contact us by telephone or email as soon as possible!

Such email solicitations are fraudulent, because you can safely assume that the same email, with other domains substituted for yours, has gone out to thousands of domain owners. I found an almost identical email (listing the same third party supposedly trying to register a domain) in another blog. Somebody obviously thinks being a registrar is a license to milk foreigners.

Don’t fall for this scam, they’re playing on fear.

If you own a .com, .net or national TLD (.co.uk, de., .fr, etc) domain but are not planning to set up a Chinese office or not even doing any business in China you have no reason to spend money on a domain registration with a Chinese registrar. Also, trademarks and domains are largely separate issues. You don’t become a trademark owner merely by registering a domain and vice versa.

The only domains that really count for your business are .com/.net/.org (depending on the nature of your organisation) and/or the country code top level domain (ccTLD, such as .co.uk or .jp) if you’re based outside the USA.

Below are other examples of domain registration spams / scams that I have received before. I am sure there are a lot more out there.

    Dear CEO/Principal,

I’m sorry to disturb you so abruptly.

We are the department of registration service in China. On November 5,2012, we received an application formally. One company named “Jiqin Investment Co.,Ltd “had applied for the net brand “xx” and some relevant domain names through our body.

Now we are handling this registration, and we found that the keyword of these domain names and net brand is identical with your company’s. So now we need to confirm a couple of things with you:
    1. If your company consigns “Jiqin Investment Co.,Ltd” to register these domain names and net brand, we will send an application form to them and help them finish the registration at once.
    2. If your company has nothing to do with “Jiqin Investment Co.,Ltd”, they maybe have other purposes to register these domain names and net brand.

We haven’t finished the registration of “Jiqin Investment Co.,Ltd” yet, and we have postponed the application of this company temporarily already. In order to deal with this issue better, please contact us by telephone or email as soon as possible.

In addition, we hereby affirm that our time limit for dissent application is 7 days. If your company files no dissent within the time limit, we will unconditionally approve the application submitted by “Jiqin Investment Co.,Ltd”

  25. Also got an email exactly like this except from simon@tsnetsolution.com about a company that wanted to register the same tdl’s as above with my company name. The company that wanted my name is Kerla Investment which does not exist anywhere on the internet. I did ALOT of research as my company is expanding worldwide over time and didn’t want to run into problems if my company name was used for a porn site or something. For everyone’s reference here is all I found. The Chinese gov’t has an internet authority www1.cnnic.cn/index.htm, where you can search out your own registrar, read about their dispute resolution policy (use their search engine to find it) and their way of doing things in China. After using godaddy to register some of the tdl’s, I found an ICANN recognized registrar in China and registered the rest of them for alot less than Simon was asking and only for a year to discourage any company if the claim was real. However, the domains tsnetsolution.com and tsnetsolution.org (which is simon’s website) were only registered in December 2012. Their website says copyright 2011 and says they have been in business for years. As well, after emailing back and forth with simon for about two weeks now, he said a few things in his emails which made it clear it was a scam. ..He hasn’t realized yet either that I already bought the names through another real registrar. Just in case you want to buy domain names, you can do your own research but I went through about 30 registrars before I found http://www.now.cn (use google to translate it). They are recognized by the CNNIC and ICANN (check ICANN website for http://www.todaynic.com of which http://www.now.cn and http://www.eranet.com, also okay, are subsidiaries) and you can find them all over the internet over many years. I paid through paypal and would suggest you do not pay any other way. We’ll see what happens when he checks and finds out that I gave my money (not much really) to another company. Becoming a registrar in China is also easy I found out so this is probably a bunch of guys who make profit from scaring people to register through them.

  26. ..More info.. surfed a bunch of the sites above and they all look the same more or less with same text and all. A new one I just found a scam for is here…http://blog.hqcodeshop.fi/archives/6-Chinese-domain-scam!.html… Good scam I have to say. Buggers are getting really good. never thought twice about this kind of stuff before… They got me really working to investigate this time!!

  29. I can confirm that this scam is still very much active, we also received email with similar text to the examples posted above from someone calling themselves “Jasson Wong” from a company using the website address http://www.dsh-web.org.cn (which is included in the message only as an image but the email address the messages were supposedly sent from uses the same domain) and claiming someone was trying to register website domains using our brand name for China, Hongkong and Malaysia-TLDs.

  30. This is indeed active, we have also received one this morning.

As we specialise in marketing communications I will just warn you. Do not even open this email, put it in spam then open it without loading the images if you need to but if you get any images they know you exist and chances are you have opened the email. This can trigger an increase in spam to your account!!

  36. Here is a new one to add to the list!
    ==============================

(Mail to the brand holder, thanks)

    Dear CEO/Principal,

I’m sorry to disturb you so abruptly.

We are the department of registration service in China. On March 15,2013, we received an application formally. One company named “XiangFeng Investment Co.,Ltd” had applied for the Brand Name “evkdesign” and some relevant domain names through our body.

Now we are handling this registration, and we found that the keyword of these domain names and Brand Name is identical with your company’s. So now we need to confirm a couple of things with you:
    1. If your company consigns that company to register these domain names and Brand Name, we will send an application form to them and help them finish the registration at once.
    2. If your company has nothing to do with that company, they maybe have other purposes to register these domain names and Brand Name.

We haven’t finished the registration of that company yet, and we have postponed the application of this company temporarily already. In order to deal with this issue better, please contact us by telephone or email as soon as possible.

In addition, we hereby affirm that our time limit for dissent application is 7 days. If your company files no dissent within the time limit, we will unconditionally approve the application submitted by that company.
