Domain registration scam in China

Various companies in China are trying to scare domain owners in other countries into registering Chinese variants of their domain names by claiming some other party was trying to register these variants. Examples of this scam have been reported widely throughout 2008, involving the domains asiaton.cn, erimut.com, erimart.com, erimart-domains.com.cn, hknsc.hk, hongkongnet.org, hk-net.org.cn, hknetwork.hk.cn and others (erimut.com, erimart.com, erimart-domains.com.cn and hknsc.hk are linked by IP address).

Here is one that I received on 2008-12-08, originating from IP 58.38.209.249:

Such email solicitations are fraudulent, because you can safely assume that the same email, with other domains substituted for yours, has gone out to thousands of domain owners. I found an almost identical email (listing the same third party supposedly trying to register a domain) in another blog. Somebody obviously thinks being a registrar is a license to milk foreigners.

Don’t fall for this scam, they’re playing on fear.

If you own a .com, .net or national TLD (.co.uk, de., .fr, etc) domain but are not planning to set up a Chinese office or not even doing any business in China you have no reason to spend money on a domain registration with a Chinese registrar. Also, trademarks and domains are largely separate issues. You don’t become a trademark owner merely by registering a domain and vice versa.

The only domains that really count for your business are .com/.net/.org (depending on the nature of your organisation) and/or the country code top level domain (ccTLD, such as .co.uk or .jp) if you’re based outside the USA.

Below are other examples of domain registration spams / scams that I have received before. I am sure there are a lot more out there.

  11. Hi, thanks for your very useful website. I received this scam too, exactly like the Hong Kong examples above. I recently registered my company’s trade mark in a European country, so this Hong Kong email by someone called Leo Wang looked quite serious first. Apparently they use European trade mark databases as their source? Or is it a pure coincidence? Fortunately I am rather suspicious and the first thing I did, was using Google with a fragment of the scam mail. That brought me to your site (and several others). Thank God that there are websites like this, informing us about this nasty type of fraude.

    the sad fact is that international online scams in general are a low priority for law enforcement in most countries, and this scam will rank low amongst other scams.

    As general rule, the police will not seriously get involved in international online scams unless the damages run into the hundreds of thousands of dollars.

    Scammers who defraud only people outside the country where they are based usually face little risk of arrest. This is not only true for scammers in China, but also in Europe, where say Nigerian scammers based in the Netherlands will refer Dutch victims to colleagues based in Spain, the UK or Nigeria (and vice versa), to make sure the police is always in another country.

    To be a bit cynical, police officers stand a better chance of getting promoted if they concentrate on cases where both the criminal and the victim are based in the same country as the officers and the courts. If they have too many cases to handle already, why should they concentrate on cases that do not directly affect their fellow countrymen?

    In the case of the registration scams, it’s not even that obvious that laws have been broken. Yes, they’re liars, swindlers, who are doing something highly unethical, but how can you or I *prove* that the third party they claim is after “our” domain names doesn’t actually exist?

    It’s not like we were placing an order for 100 cell phones, pay for them and then not receiving them. When even that kind of openly criminal scam barely gets prosecuted, what hope is there with scams like these? Not much.

    While there is a lot to be done to clean up internet related services in China (including numerous international spam gangs using Chinese servers as hubs of their criminal botnets), relatively small scale scams like this one are not going to be at the top of anyone’s list.

  21. Thanks for this. I received an email from hknsc.hk. first thing this morning. Initially I dismissed it as a scam but got a bit worried when I saw their quantcast rating and wondered if they are were actually a large and legitimate company. Typed in hknsc scare in Google and found the posts to your site which seem to indicate they are just out to scare domain owners in to registering useless domain names. I suppose they could actually build their whole business on this – considering how many poeple worldwide will respond to them. The company they allege to be in pursuit of our domain name has “zero” presence on the Net. Thanks for the information.

  26. We have had two e-mials..an ‘introduction’ and then a second, more detailed message of ‘intent’ listing the seven domains that this ‘company’ was intending to register’on behalf of their ‘client’ .

    Ours was another one generated using hk-nsc.org but this person openly gives his web address as ‘www.hknsc.hk’ a legitimate looking company that actually shows its true e-mail contact is ‘info@hknsc.hk’

    Our ‘contact’ is a Henry William.
    However, his command of the English Language is not quite all that one might expect from someone with such an Anglo Saxon name……I wonder whether he has Charles, James and George as middle names…….

  30. I replied to this guy, asking how much to register the domains. Their prices were reasonable, however the catch was it was a minimum 5 years registration period. If we had registered all of them for 5 years, the cost would have run to a couple of thousand dollars. He even had the hide to phone me after emailing a registration form. His accent was Chinese, but he had clearly learned his English from someone with an American accent.

    I did some quick checks and found that the website mentioned in his address block failed to work. Another tell-tale sign it was a scam is that his email domain didn’t match his website domain. I ran a Who-Is check on the website domain name and interestingly it had only been registered two weeks prior to me receiving his solicitation:

  41. Thanks for posting about this scam. I received a similar email today (see below) and thought it might be real. I briefly considered registering the .asia domain name but only through my preferred registrar.

    We are a domain name registration and dispute organization in Asia, which mainly deal with the global companies’ domain name registration and internet Intellectual property right protection. Currently, we have a pretty important issue needing to confirm with your company.

    On July 13, 2009, we received an application formally. One company named “LYP International co., Inc” wanted to applied for the domain names”YOURDOMAIN.asia,etc.” and Internet keyword “YOURDOMAIN” through our body.

    Now we are handling with the registration of these domain names and find that the keyword of these domain names and internet keyword is identical with your company’s. So we have to confirm with you at two points:
    1. If your company consign LYP company to register these domain names and internet keyword, we will send application form to them and help them finish the registration at once.
    2. If your company have nothing to do with LYP company, they maybe have other purposes to register these domain names and internet keyword.

    This shows that
    1) the domain was registered with an incomplete postal address.
    2) the registrant is unaware that Hong Kong doesn’t use post codes. Mainland China uses six digit codes such as 519000 (the city of Zhuhai in Guangdong province), but Hong Kong does not.
    3) The domain was only registered one week ago.
    4) the listed phone number is a Chinese number, not a Hong Kong number.

    These scammers are not based in Hong Kong as they are trying to make you believe, but in mainland China. That’s where their website is hosted too.
